Whatever happened to the suit against USM?
Permalink Closed

I have been away from the website for a while (and buy, have things developed during my absence!), so I am curious to know the status of the lawsuit filed by the terminated professor of education (I believe her name is Melissa Whiting).  Is it still in process?  I am keeping my fingers crossed for her.

I don't know the answer to your question, USM Sympathizer, but I do want to say that it's great to have you back on board this bus. We missed you.

I believe it goes to trial in January.

It's in the federal court system. The only hangup is concerning constitutional vs. civil rights. The judge (Ivan LeMelle) recognizes the importance of the suit, and when it gets to court - a lot of Thames's dirty little secrets will be legally revealed.  Thames has been reported saying that they'll appeal all the way to the Supreme Court. And, it could end up there - those of us following the suit more closely see this as a possibility given the arrogance of the Thames regime (and IHL) and the fact that they are spending OUR money instead of their own.

Whiting and Chaze are not intimidated by their posturing, but they too would like to get on with it and finish it at this federal level.  Remember that when Whiting received the positive recommendation for tenure and promotion from the UAC and Provost in the spring- Thames refused to speak with herabout it the entire summer, instructed the media to not release the list in June as they usually do but wait until late July to do it, didn't recommend her or not recommend her tenure and promotion to the IHL until well into September, and did not offer her a contract in August. He followed his own protocol, Whiting was out of a job without any prior notification, but at least he can't blame Tim Hudson for this one.  Once again, he felt he was above playing by the rules in place.

Thanks!  Things had died down a bit on the board, so I got out of the habit of checking it each day.  Imagine my surprise when I checked it on Friday and discovered everything that has happened lately!  Please know that I and lots of other people from around the country DO care what happens to the good people at USM who have had to suffer under Shelby.
