Board Policy - Presidents' Contracts Beyond Age 70

On page 7 of this week's Independent, a story on SFT's future as President includes this interesting bit of information:


"Of major concern to some members is the Board's policy of not renewing Presidents' contracts beyond the age of 70, the age at which Thames will be when his present contract expires next year. The Board has ignored that policy only one time and that with the renewal of the contract by Dr. Walter Washington, then President of Alcorn State University, when he was 68 years old. Dr. Washington was 72 when his last four-year contract expired and he asked Board members for an additional four years as Alcorn President. The Board rejected that request."

Thank you. To my knowledge, I'm not related to anyone named Barney. The only Barneys I know are the ones on television-- the purple dinosaur; Fred Flintstone's best friend; and Deputy Fife.

Back to the original thread topic, the "age 70" Board policy is interesting, particularly if SFT is campaigning for another four-year term. Based on what happened with Dr. Washington at Alcorn, another four-year term as President won't happen.

Yes, this "policy" (whether official or unofficial) gives the IHL the perfect excuse to hand Shelby his walking papers.  It also gives Shelby and his supporters the perfect fig leaf ("he wasn't fired; they just never reappoint anyone over 70").  It is a win-win option for everyone.  I sincerely hope that the IHL "remembers" this policy and the precedents that have been established in support of it.

there is no "official" policy about 70 in the IHL's bylaws. i wonder how they could enforce this given laws about age discrimination. Walter Washington is interesting because he was not renewed at a time when there was mandatory retirement in higher education at age 70. however, the law permitting this expired at the end of '93 (coincidentally, just when Washington was not renewed). below is an excerpt pertaining to this:

The Age Discrimination in Employment Act of 1967 (ADEA), prohibits employers from using age as a basis for making hiring, firing, promotion or compensation decisions, or from limiting, segregating or classifying employees in any way that would deprive them of employment opportunities or adversely affect their employment status, including enforcing mandatory retirement ages. Under a special ADEA exemption enacted in 1986, postsecondary institutions were permitted to enforce mandatory retirement for faculty who reached the age of 70. The exemption was limited to seven years, however, and it expired at the end of 1993.

Danggit, SCM; why do you have to be so logical?!


I wonder if they could do it "unofficially" and just say that a long-standing precedent exists.  Does anyone know of any presidents since 1993 who have been older than 70?

And if it does happen, it will be interesting to hear them explain why an exception was made for one president, but not for the other.

Using age as a detriment to university employment is a dangerous thing. Age is not a job-related characteristic. Performance and ability to do the job is the only legitimate critierion. If a university presidency is limited by age it would be possible to use age as the basis for continuance of the appointments of other university employees including faculty members. Then could come gender, or religion, or other irrelevant factors. Those who take joy in hoping that 70 will be the age cut-off for employment of university presidents are well advised to think about the potential negative consequence of such a policy. Such a policy would be a money-saver for the university (older and more experienced faculty usually command a higher salary) and could be used as justification for terminating the higher paid faculty and other employees.
