The U.S. News ratings use peer evaluations as a major factor in their tier rankings. In fact, peer evaluation is weighted higher than any of the other factors in determining tier status: 25%! It would seem unlikely that USM could move back up to 3rd tier if the peer evaluation factor drops. Peer evaluations are a cinch not to go up this year. They will very likely plummet. It's a good thing there is not a 5th tier.

And this is even more disturbing when one considers that we were very near the bottom rung of the fourth tier. To get back to third tire we'd have to hop over a many schools that don't face the problems we face. We'd be lucky to retain our current tier ranking.
I noticed back in August that USM dropped from the 3rd to the 4th tier, even though its average peer evaluation had gone down just 1/10 of a point (on a 5-point scale). The damage will show up in peer evaluation scores next year.
